The following general terms and conditions of BODEGAS YZAGUIRRE, S.L. (hereinafter, “the Owner”) apply to orders placed within the Iberian Peninsula and the Balearic Islands. The version in force at the time of placing the order shall apply.
These terms and conditions apply only to orders placed via the Website and shall comply with the relevant legislation and, in particular, with Spanish Royal Legislative Decree 1/2007 of 16 November amending the consolidated text of the General Consumer and User Protection Act, and complementary legislation.

These general terms and conditions of business (hereinafter, the “Terms and Conditions”) govern the procurement of products and services offered by BODEGAS YZAGUIRRE via its Website, in addition to the rights and obligations of the parties arising from sale and purchase transactions and the provision of agreed services.
By placing an order on this Website, the consumer or user accepts all the Terms and Conditions set out in this document. The contracts on this website may be signed in the Spanish language.
All orders are subject to availability of stock. Our services will be invoiced as soon as the consumer accepts the Terms and Conditions and places the order. However, in the event of a supply incident or a lack of stock, the customer will be informed immediately and reimbursed any amounts paid at their request.

Purchase process and Delivery policy
To order a product or service offered on this Website, you are required to complete the fields with the mandatory data and accept these Terms and Conditions. By ticking the Accept box, the customer fully and unreservedly accepts all the general terms and conditions published by the Owner on the Website, which are binding on the parties.
Bodegas Yzaguirre will ensure that the products and services offered have legal coverage, quality guarantees and, where appropriate, the corresponding insurance.
To place an order, the customer must select the products they wish to purchase and add them to the shopping cart by clicking the “Add to cart” button. After doing so, they must click the “Pay now” button.
To process the order, they will be prompted to provide additional data that were not provided when they registered on the Website, and to choose a payment method. After providing this information and accepting the order, the purchase process is complete.
All transactions are carried out on secure payment platforms and with a guarantee that the consumer’s data will be kept strictly confidential.
After confirming payment, the transaction will be completed and the customer will receive a confirmation email with details of their order.
The customer will receive their order at the address they indicated (home or work address, etc. – never at the post office).
The delivery costs will be specified after the consumer has entered the delivery address for the order.
Products that are in stock are normally delivered within the period indicated on the Website. The expected delivery date of the order is indicated in the order confirmation. We will inform the consumer of any delays in delivery and will continue to monitor their order.

Within 48/72 hours of dispatch within the Iberian Peninsula (mainland Spain).
The delivery period begins on the date the order is dispatched from the warehouse and will depend on the availability of the chosen product and the destination. Transport times are approximate.
The prices of our products and services are indicated on the Website. All prices shown include VAT at 21% for purchases within the Iberian Peninsula.
The price indicated does not include delivery costs, given that these costs vary depending on the destination and weight of the final order.
If, after placing an order, an error is detected in the price of an item or service, the Owner will contact the consumer as soon as possible to inform them and give them the option to cancel the order or accept the corrected price conditions.
An automatic email confirmation does not validate price errors. If the consumer chooses to cancel the order, the amounts paid will be reimbursed in full. No orders will be dispatched until the consumer has expressly accepted the corrected price conditions.
The Owner reserves the right to change the prices of the products and services offered on the Website at any time. The final price will be the price published on the Website at the time the order is placed, without prejudice to any updates that may be made, as specified in section 3.a) of these Terms and Conditions.
The Owner will do everything in its power to provide accurate information free from typing errors on the Website.
If there are additional costs for service, transport or special product features, the consumer will be notified accordingly and these will be indicated in the final price breakdown shown before payment.
Right of withdrawal and Returns policy
You are entitled to withdraw from this contract within 14 calendar days without having to give a reason. The right of withdrawal entitles the consumer to return the product purchased without having to give a reason for their decision. The consumer has fourteen (14) calendar days, beginning on the day after the product was received, to return it.
The right of withdrawal shall not apply in the following cases:
Sealed products that are not suitable for return due to health protection or hygienic reasons if unsealed.
- When the nature of the product or service makes it impossible to terminate the contract.
- Services that have been delivered in full with the express consent of the consumer or user.
- Products which, due to their nature, and following delivery are inseparably mixed with other items.
- Products custom-made to the user’s or consumer’s specifications or clearly personalised.
- Products which may deteriorate or expire rapidly.
To exercise the right of withdrawal, the consumer shall notify BODEGAS YZAGUIRRE, S.L., Carretera de Reus km 7,8 – El Morell, Tarragona (Spain), tel. no. +34 977 840 655, email firstname.lastname@example.org, of their decision to withdraw from the contract by means of a clear statement (for example, a letter sent by normal mail, fax or email). You may use the withdrawal form below but are not obliged to do so.
Alternatively, you may complete and send us the withdrawal form or a clear statement to that effect via the website www.bodegasyzaguirre.com. If you choose this option, we will confirm receipt of your withdrawal request without delay in a durable medium (such as by email).
To be within the statutory withdrawal period, it shall suffice that the request to exercise the right of withdrawal is sent within the relevant time limit.
Consequences of withdrawal:
If you withdraw from the contract, we will return the payment we received from you in full and without undue delay, including delivery costs (except for any additional costs incurred if you choose a delivery method other than the least expensive ordinary delivery method we offer) and, in any event, within no more than 14 calendar days of the date of you informing us of your decision to withdraw from the contract. We will reimburse you using the payment method you chose in the purchase transaction, unless you expressly request otherwise; in any event, you will not incur any charges as a result of reimbursement.
We may withhold reimbursement until we receive the product you were sent or you provide proof of having returned the product, whichever occurs first. The Owner reserves the right to check that the returned product is in normal condition of use for a 14-day period. In addition, the product must be returned to the Owner with its original packaging, accessories and other material, along with the receipt or invoice.
You will have to bear the direct cost of returning the products.
The Owner reserves the right to reject returns notified or sent outside the relevant time limit, or which are not in the same condition in which they were received.
Returns must meet all the conditions set out here to be accepted. Any charges, taxes or customs duties will be borne by the consumer.
Obligations of the consumer
The consumer shall use our products correctly, and accepts sole responsibility for any damage or injury caused to Bodegas Yzaguirre or third parties due to negligence or wilful misconduct.
In addition, the consumer is solely responsible for the safekeeping on its premises of products supplied by Bodegas Yzaguirre.
By accepting these Terms and Conditions, the consumer accepts responsibility for the veracity and accuracy of the information provided to us as a result of the online sale/purchase contract.
Intellectual and industrial property
The products and services we make available for purchase on our Website are protected by copyright law. In addition, logos, trademarks, texts, icons and other content subject to intellectual and industrial property rights are protected by the relevant laws. The Owner has obtained authorisation from the relevant copyright holders to use the content and materials.
Settlement of disputes
Any disputes that may arise between the consumer and the Owner as a result of a breach of the Terms and Conditions shall be governed by the provisions of the relevant legislation, which is the Law of Spain.
If any of these terms are deemed invalid or unenforceable, that term will be deemed severable and will not affect the validity and enforceability of the remaining terms.
Furthermore, you are hereby informed that the European Commission provides an out-of-court European Online Dispute Resolution platform in relation to the contractual obligations arising from online sale/purchase and service agreements between consumers and traders resident in the European Union, with the intervention of an alternative dispute resolution body.
